General terms – Waste acceptance (B2B and B2C – Belgian law)

1. Acceptance of the terms

Any order or container reservation implies full and unconditional acceptance of these general terms, whether the customer is a business (B2B) or a private individual (B2C).

These terms are established in accordance with the Belgian Code of Economic Law, in particular Articles VI.2 to VI.42 concerning contract formation and consumer protection, and with the regional provisions applicable to waste management.

2. Rental period

• The standard rental period included is five (5) working days (seven (7) calendar days).
• Each additional day is charged at €5 excluding VAT and must be paid before the container is collected.

3. Service hours and legal framework

• Brussels-Capital Region: deliveries are permitted Monday to Friday, from 7 a.m. to 7 p.m., in accordance with the Government Order of 21 November 2002 on waste management.
• Flemish Region: municipal time restrictions must be respected, in accordance with VLAREMA (Article 5.2.1) and local nuisance regulations.
• Walloon Region: deliveries are permitted from 6 a.m. to 10 p.m. on weekdays, in accordance with the Waste Decree of 27 June 1996.

4. Container placement

a) Public road:

• The customer must obtain a municipal parking permit at their own expense.
• After delivery, the customer alone is responsible for signage. GGR accepts no liability for fines or offences.

b) Private property:

• The customer must be present and indicate the exact location of the container.
• GGR accepts no liability for damage to the ground or infrastructure. The customer must provide adequate protection.

5. Weight and overloading

The maximum permitted weight per container is 10 tonnes. Above this limit, the following surcharges apply:

No waste may extend above the edges of the container. If the permitted volume is exceeded, charges apply per estimated additional cubic metre:

7. Prohibited waste

It is strictly prohibited to place the following in the container:

• Toxic, chemical or medical waste
• Organic or food waste
• Flammable materials, asbestos or roofing materials
• Wet paint, tyres or textiles

Any breach results in automatic reclassification of the load as hazardous waste at a flat rate of €300 excluding VAT per tonne, without the possibility of removal or dispute.

All waste is photographed and inspected at the sorting centre. Additional penalties may apply in cases of obvious fraud or concealment.

8. Unsuccessful trips and waiting time

• Any unsuccessful trip (blocked access or insufficient space): €180 excluding VAT, payable before rescheduling.
• Waiting time beyond 15 minutes: €100 excluding VAT per hour.

9. Payment and delivery time

• Payment is made by bank transfer through the online reservation form before any delivery.
• Once payment has been received, delivery is scheduled within 24 to 48 working hours.
• This timeframe is indicative and the customer may not dispute a delay, particularly when caused by logistics or traffic.

10. Liability and limitations

• GGR accepts no liability for indirect losses, loss of income or material damage caused by container placement, except in cases of gross negligence or intentional misconduct.
• In all cases, GGR’s liability is limited to the total amount invoiced for the service concerned.

11. Force majeure

GGR cannot be held liable in cases of force majeure: extreme weather, strikes, breakdowns, blockages, administrative decisions or any circumstance beyond its control.

12. Amendments

GGR reserves the right to amend these terms at any time. The new terms apply to orders placed after their publication.

13. Applicable law and jurisdiction

• Belgian law alone applies.
• Any dispute falls exclusively within the jurisdiction of the courts of the Brussels district.
